Accident investigation

An accident related to work activity is the impact on an employee of a harmful and dangerous production factor in the performance of his labor (official) duties or tasks of the employer, as a result of which an industrial injury, sudden deterioration of health or poisoning of an employee occurred, which led them to temporary or permanent disability or death.

Validity of documents:
Employees – at least once a year.
Managers and persons, at least once every three years, are trained and tested on occupational safety and health at the training center. In case of violation of the requirements for the investigation of accidents by the employer, the following liability measures are provided for: the Administrative Code of the Republic of Kazakhstan.
Article 95. Failure to ensure the investigation of work-related accidents
1. Failure to ensure the investigation of accidents related to labor activity, in accordance with the requirements of the labor legislation of the Republic of Kazakhstan - entails a fine for small businesses or non-profit organizations in the amount of thirty-five, for medium-sized businesses - in the amount of seventy, for large businesses - in the amount of one hundred and forty monthly calculation indices.
2. The action provided for in the first part of this Article, committed repeatedly within a year after the imposition of an administrative penalty, - entails a fine for small businesses or non-profit organizations in the amount of seventy, for medium-sized businesses - in the amount of one hundred and forty, for large businesses - in the amount of two hundred and eighty monthly calculation indices.

Article 96. Failure to report the fact of an accident related to work
1. Failure to report the fact of an accident related to work, - entails a fine for small businesses or non- profit organizations in the amount of seventy, for medium-sized businesses - in the amount of one hundred and five, for large businesses - in the amount of one hundred and forty monthly calculation indices.
2. The action (inaction) provided for by the first part of this Article, committed repeatedly within a year after the imposition of an administrative penalty, - entails a fine for small businesses or non-profit organizations in the amount of one hundred and forty, for medium-sized businesses - in the amount of two hundred and ten, for large businesses - in the amount of two hundred and eighty monthly calculation indices.

Article 156. Violation of labor protection rules
1. A violation of safety regulations, industrial sanitation or other labor protection rules committed by a person who was responsible for organizing or ensuring compliance with these rules, which inadvertently caused moderate harm to health, is punishable by a fine in the amount of up to one hundred sixty- month calculation indices or correctional labor in the same amount, or involvement in public works on

The same act that inadvertently caused serious harm to health, - is punishable by a fine of up to two hundred monthly calculation indices or correctional labor in the same amount, or community service for up to two hundred hours, or arrest for up to fifty days, with deprivation of the right to hold certain positions or engage in certain activities for up to three years.
3. The act provided for in the first part of this Article, which caused the death of a person by negligence - is punishable by restriction of liberty for a term of up to five years or imprisonment for the same term, with or without deprivation of the right to hold certain positions or engage in certain activities for a term of up to three years.
4. The act provided for in the first part of this Article, which caused the death of two or more persons by negligence, is punishable by restriction of liberty for up to seven years or imprisonment for the same term, with or without deprivation of the right to hold certain positions or engage in certain activities for up to three years.
